The tax return Preparer Penalty, the Taxpayer Accuracy-Related Penalty, and the FIN 48 (Accounting Standards Codification subtopic 740-10, Income Taxes — FASB ASC 740-10) Recognition standard each require the tax professional to evaluate and weigh “tax authority” to arrive at various “confidence thresholds” in order to avoid imposition of penalties or in the case of FIN 48 to “recognize” a tax benefit or evaluate if a reserve for tax penalties must be made. Different confidence thresholds may apply for tax preparer and taxpayer penalty determination depending on disclosure and whether or not the tax position under evaluation may be a tax shelter.
In addition, Circular 230 governing CPAs, enrolled agents and attorneys that practice before the IRS mandates compliance with these rules and so do the AICPA Statements on Standards for Tax Services (“SSTSs”) that virtually all State Boards of Accountancy have adopted as enforceable standards.
Presented by highly regarded practitioner, Kip Dellinger, CPA, this helpful session will examine what constitutes “authority” and evaluating the relative weight of authority for purposes of FIN 48 recognition and for avoiding taxpayer or preparer penalties in compliance with the required confidence thresholds. Kip Dellinger is Managing Director of Dellinger & Associates, a division of Kallman and Co. LLP, CPAs, in Los Angeles. Kip is the Immediate Past-Chair of the AICPA Tax Division’s Tax Practice Responsibilities Committee and Immediate Past-Chair of the California CPA Society’s Los Angeles Committee on Taxation.
Kip has extensive experience involving sophisticated income tax planning and handling of tax controversy matters for high-income individuals, family-owned and closely-held businesses, fiduciaries and estates.
