While Code Section 1031 and its predecessors have been available to taxpayers since the earliest Revenue Acts of the 1920s, recent years have seen this area of tax practice become a minefield for the unwary and unstudied. Sure, the tax theory of exchanges has remained the same since the earliest statutes permitted them, with 1031 remaining largely unchanged since it appeared in 1939 IRC. But many cases and rulings under Sec. 1031 have created a complex series of traps and a intricate set of requirements for complying. Since introduction of the Regulations in 1991; the Reverse Exchange Rev. Proc. in 2000 and the tenant in common Rev. Proc in 2002; and the recent Teruya case that essentially struck down related-party exchanges, successfully structuring of exchanges has become far more complex.

Nancy Grekin is an attorney well versed in tax and real estate law and has spent years observing the evolution of Sec. 1031 practice.
